These terms form the agreement between you and ES-SAHM Saifeddine, who operates Enlumine, and govern your use of the service.
Summary
Your documents stay yours. You need to be 16 or older. Do not upload things you have no right to hold, and do not use the AI features to break the rules of the model providers we route through.
There is a free plan. A first paid payment can be refunded within 14 days, less the credits it granted that you spent, and cancelling stops the next renewal rather than cutting you off. If your account holds more than its plan allows, we email you twice and give you seven days before anything is removed.
This summary is provided for convenience only. It does not form part of the agreement, and the numbered terms below govern.
1.1These Terms of Service (the “Terms”) govern your access to and use of Enlumine. By creating an account or using the service, you agree to be bound by them. If you do not agree, do not use the service.
1.2Our Privacy Policy and Refund Policy form part of these Terms. Where a refund is concerned, the Refund Policy governs and these Terms are read alongside it.
1.3The operator of the service is identified in the Privacy Policy, which names the data controller for the purposes of data protection law.
2.1“Enlumine”, “we”, “us” and “our” mean ES-SAHM Saifeddine, operating the service at enlumine.app.
2.2“Service” means the Enlumine application, including the document library, the reader, search, the assistant and the other features made available through it.
2.3“Account” means the account you create in order to use the Service.
2.4“Content” means the documents you upload and everything you create in the Service in connection with them, including annotations, bookmarks, tags and conversations with the assistant.
2.5“Plan” means the tier your Account is on, which determines the features it can reach and the storage it includes.
2.6“Credits” means the unit of account used to pay for AI features, for storage above the amount your Plan includes, and for any other feature we make payable in Credits. Credits are a prepaid balance for use within the Service only. They are not money, not a stored-value instrument, not transferable, and have no cash value outside the Service.
2.7“Subscription” means a recurring paid Plan, billed monthly or annually.
2.8“Merchant of Record” means the third party that sells Subscriptions and Credits to you, processes payment, and is the seller for the purposes of that transaction.
3.1You must be at least 16 years old to use the Service. By creating an Account you represent and warrant that you are.
3.2If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or legal guardian, who accepts these Terms on your behalf and is responsible for your use of it.
3.3We do not ask for your date of birth and do not otherwise verify age. If we become aware that an Account belongs to someone below the required age, we will close it and delete the data held under it.
3.4You must not use the Service on behalf of a person or organisation that has told us not to, and you must not use it where doing so would breach sanctions or export control law that applies to you.
4.1You are responsible for everything that happens under your Account. Keep your sign-in credentials secure and do not share them.
4.2Tell us promptly at contact@enlumine.app if you believe someone else has gained access to your Account.
4.3You may delete your Account at any time from within the Service. Deletion is immediate and irreversible; Section 12 sets out what it removes.
5.1You retain every right you already held in your Content. We claim no ownership of it.
5.2You grant us a limited, non-exclusive licence to host, store, copy, transmit and process your Content solely so that we can provide the Service to you and to the people you share a workspace with. That licence exists only for that purpose and ends when the Content is deleted.
5.3You must have the right to upload what you upload. You represent and warrant that your Content does not infringe the rights of anyone else, and that holding and processing it through the Service is lawful.
5.4We do not review Content before it is stored. Where we are notified of Content that infringes a third party's rights or breaches Section 11, we may remove it.
6.1The Service, its software, its interface and the Enlumine name and marks belong to us or to our licensors. These Terms grant you a personal, non-transferable, revocable right to use the Service, and no other rights.
6.2You must not copy, modify, reverse engineer, resell or create a derivative of the Service, except to the extent that applicable law expressly permits it despite this restriction.
7.1A Plan determines which features your Account can reach and how much storage it includes. The features and prices of each Plan are set out on our pricing page.
7.2Payment is taken by Polar, acting as Merchant of Record. Polar are the seller for that transaction: they charge you, they appear on your statement, they are responsible for sales tax and VAT, and their own buyer terms govern the payment. These Terms govern the Service you receive for it.
7.3Prices are stated exclusive of tax. Any sales tax or VAT due in your country is added by the Merchant of Record at checkout.
7.4A Subscription renews automatically at the end of each billing period until it is cancelled. You may cancel at any time, and Section 8 sets out what cancelling does.
7.5A paid Plan includes an allowance of Credits each time it is paid for, and you may buy additional Credits at any time. Credits can be spent as soon as they are granted. They are consumed by work actually performed on your behalf, such as a request to an AI model or a month of storage above your Plan's included amount.
7.6Credits you have not spent remain on your Account for as long as the Account exists. They do not expire and they carry across renewals. They are extinguished if the Account is deleted.
7.7We may change our prices. A change to the price of a Subscription will not affect a period you have already paid for, and we will tell you before it applies to your renewal.
8.1You may cancel a Subscription at any time. Cancelling stops the next renewal; it does not end the period you have already paid for. Your access continues until that period ends, after which the Account returns to the free Plan.
8.2Cancelling a Subscription is not the same as deleting your Account. Your Content remains, subject to Section 9.
8.3Refunds are governed by our Refund Policy, which forms part of these Terms and sets out the period within which a Subscription or unspent Credits may be refunded.
8.4Nothing in this Section or in the Refund Policy limits a statutory right you have as a consumer.
9.1Every Plan includes an amount of storage, stated on the pricing page. While your Account is within that allowance we do not remove anything.
9.2On a paid Plan you may hold more than the included storage by setting a maximum. Storage above the included amount is charged monthly from your Credits, for what you actually stored.
9.3If your Account comes to hold more than it is paying for — because a paid Plan ended and the Account returned to the free allowance, or because your Credits did not cover a month of additional storage — uploads pause and we email you the date and the documents that would be removed, remind you two days before, and give you seven days. During that time you may download what you want to keep, delete documents yourself, or add Credits.
9.4After that period we remove documents until the Account is within its allowance, starting with the largest, and email you what was removed. Nothing is owed to us afterwards.
9.5Removal under this Section is permanent and cannot be undone. This is why the notice period exists, and why Section 13 asks you to keep your own copies of anything you cannot afford to lose. Your documents are PDFs and download exactly as you uploaded them.
9.6Losing a paid Plan does not lock you out of the Service. The reader, your annotations, your tags and full-text search continue to work on the free Plan; features that Plan does not include stop.
10.1The assistant can be wrong. It summarises and answers questions about your documents using a language model, and language models make mistakes, including confident ones. Check anything that matters against the document itself.
10.2You are responsible for what you do with its output. Do not rely on it as legal, medical, financial or other professional advice.
10.3AI features reach a model through a routing provider, which passes the request on to the company that runs the model. Using those features means agreeing to comply with the acceptable-use policies of that routing provider and of the model provider your request is routed to. Those policies prohibit, among other things, generating material that sexually exploits children, and using a model to develop weapons or to conduct attacks.
10.4We are answerable to those providers for what is done through our account with them. A breach of their policies is a breach of these Terms, and we will close an Account that commits one.
11.1You must not use the Service to break the law, to store or distribute material you have no right to hold, to infringe anyone's intellectual property, or to store material that is unlawful to possess.
11.2You must not attack, probe, overload or disrupt the Service or its infrastructure, attempt to gain unauthorised access to it or to another user's data, or circumvent the limits of your Plan.
11.3You must not resell, sublicense or provide the Service to third parties as a service of your own.
11.4If you believe someone is using the Service in breach of this Section, report it to abuse@enlumine.app.
12.1We may suspend or terminate your Account if you breach these Terms, if we are required to by law, or if doing so is necessary to protect the Service or its users. Where we reasonably can, we will tell you why first.
12.2We may also terminate this agreement for convenience by giving you reasonable notice.
12.3You may stop using the Service and delete your Account at any time. Deleting your Account removes your documents, annotations, conversations, tags and usage history, and is immediate and irreversible. The Privacy Policy describes exactly what deletion removes.
12.4If you delete your Account or we terminate it, any unspent Credits are extinguished and any Subscription ends. Termination does not entitle you to a refund except as set out in the Refund Policy or as required by law.
13.1We work to keep the Service running but do not promise that it will be available without interruption. It may be unavailable for maintenance, or because something we depend on has failed.
13.2Keep your own copies of anything you cannot afford to lose. We take backups for our own recovery. They are not a backup service for you, and we do not undertake to restore individual Content from them.
14.1To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
14.2We do not warrant that the Service will meet your requirements, that it will be uninterrupted or error-free, or that the output of any AI feature will be accurate or complete.
14.3If you are a consumer, this Section does not affect the rights your local law gives you, and nothing in it excludes a warranty that cannot lawfully be excluded.
15.1Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.
15.2Subject to the clause above, our total liability to you arising out of or in connection with these Terms or the Service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.
15.3We are not liable for loss of profits, loss of business, loss of goodwill, or loss or corruption of data, in each case whether direct or indirect.
15.4If you are a consumer, you keep every right your local law gives you, and nothing in these Terms takes those away.
16.1If you use the Service in breach of these Terms or of the law, you agree to indemnify us against claims, losses and reasonable costs that result from it, including claims that your Content infringes the rights of a third party.
16.2This Section does not apply to the extent that you are a consumer and the law where you live does not permit it.
17.1We may change the Service, including by adding, altering or withdrawing features. Where a change materially reduces what your Plan provides, we will tell you before it takes effect.
17.2We may update these Terms. If a change materially affects you, we will tell you before it takes effect, and continuing to use the Service after that date means you accept the updated Terms. If you do not accept them, you may delete your Account.
17.3The date at the top of this page records when these Terms were last changed.
18.1These Terms and any dispute arising out of them are governed by the law of Morocco, and the courts of Morocco have jurisdiction over them.
18.2If you are a consumer resident in the European Union or the United Kingdom, this does not deprive you of the protection of the mandatory law of your country of residence, and you may bring proceedings in the courts there.
18.3Before bringing a claim, please contact us at contact@enlumine.app so that we can try to resolve the matter.
19.1Entire agreement. These Terms, together with the Privacy Policy and the Refund Policy, are the entire agreement between you and us about the Service, and replace any earlier understanding about it.
19.2Severability. If a provision of these Terms is found to be unenforceable, the rest continues to apply.
19.3No waiver. If we do not enforce a provision on a given occasion, that is not a waiver of our right to enforce it later.
19.4Assignment. You may not transfer your rights under these Terms without our consent. We may transfer ours to a successor of the business, provided your rights under these Terms are not reduced.
19.5Notices. We give notice to the email address on your Account. You give notice to us at contact@enlumine.app.
19.6Events outside our control. We are not liable for failure to perform caused by something beyond our reasonable control.
19.7Survival. Sections 5, 6, 14, 15, 16, 18 and 19 survive termination of this agreement.
